The Commission proposes to amend Regulation 67-1605, Lump Sum Payment (PDF) . The Commission unanimously approved to proceed with publication of the Notice of Drafting of the proposed regulation change in R67-1605 Lump Sum Payment in the June 28, 2013 issue of the State Register. Commuted Value Discount Advisory Committee Recommendation (PDF) . At the regular business meeting on January 22, 2013, the Commission received the recommendation from the Commuted Value Discount Advisory Committee proposing to amend the language in Regulation 67-1605 Lump Sum Payment. The Commission accepted the information as presented for further consideration by the Commission. At the regular business meeting on April 15, 2013 (PDF) , the Commission approved the recommendation to amend the language in R 67-1605 Lump Sum Payment as presented by the Advisory Committee.

The SC Workers' Compensation Commission will conduct a public hearing on Tuesday, May 29, 2012 (PDF) , at 10:30 a.m. in Hearing Room A at the Commission to receive comments on the proposed new Regulation on Mediation,
R 4286. 

At a Special Business Meeting on Monday, April 9, 2012 (PDF) , the Commission approved the language for the Proposed Mediation Regulation. 

Proposed Mediation Regulations (PDF) will be submitted for publication in the April 27, 2012 South Carolina State Register. Public Hearing is scheduled for May 29, 2012.

Commission Proposes to Draft a New Mediation Regulation (PDF)  
At the regular business meeting on January 17, 2012 the Commission received the recommendation from the Mediation Advisory Committee proposing a new regulation to give Commissioners authority to order mediations, create a list of cases for which mediation before any hearing would be beneficial to all parties and deal with procedural issues to include, but not be limited to, requesting mediations, selecting mediators, and costs. The Commission unanimously approved to proceed with publication of the Notice of Drafting of the proposed regulation in the February 24, 2012 issue of the State Register. 

 

67-706 Oral Argument

At the February 19, 2013 Business Meeting, the Commission voted to formally withdraw Document No. 4283 from consideration by the General Assembly. The proposed change requires parties to arrive at the Appellate Panel Hearing 30 minutes prior to the schedule time for the hearing to begin.

Proposed Change to Regulation 67-706 - Oral Argument
At the regular business meeting on January 17, 2012 the Commission approved a schedule for the proposed amendment to Regulation 67-706. The amendment requires parties to arrive at the Appellate Panel Hearing 30 minutes prior to the schedule time for the hearing to begin. The Notice of Drafting was published in the State Register on December 23, 2011. The Commission will consider the proposed language to submit to the State Register for publication and Notice of Public Hearing at the February 21 Business Meeting.

67-1302 Maximum Allowable Payments to Medical Practitioners

At the March 19, 2012 Commission Business Meeting, the Commission voted to formally withdraw the Regulation R 4188 from consideration by the General Assemly. The proposed change deletes the language in R 67-1302 referencing the medical fee schedule based upon relative values and a single conversion factor.

Regulation Changes Effective February 26, 2010

The Commission amends and adds regulations to Chapter 67 to reflect changes in Title 42 necessitated by the approval of Act 111 on June 25, 2007. The amendments, deletions, and additions further reflect grammatical changes, the ability to receive and to serve forms and documents electronically, changes in electronic data interchange procedures, and additions in attorney fee petition procedures.
